1. Acceptance of Terms

By accessing, browsing, or using Metriqon (including all features, content, and services available at metriqon.thinkrium.ai), you acknowledge and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, do not use this service.

These terms apply to all users, including guests, customers, and premium subscribers. Your continued use of Metriqon after any modifications to these terms constitutes your acceptance of the updated terms.

2. Service Description

Metriqon is an AI-powered metabolic intelligence platform designed to provide personalized health insights and recommendations. The service includes:

• Metabolic age calculations based on your unique physiology
• Basal Metabolic Rate (BMR) and Total Daily Energy Expenditure (TDEE) analysis
• Lean mass risk scoring to assess body composition
• Personalized protein targets based on your fitness goals and metabolism
• AI-generated meal plans tailored to your metabolic profile
• PDF reports suitable for sharing with healthcare providers
• Special insights for GLP-1 medication users

Metriqon is designed for fitness enthusiasts, individuals tracking body composition changes, GLP-1 medication users, and anyone interested in optimizing their metabolic health.

3. Account Registration

Age and Eligibility

You must be at least 18 years of age to create an account and use Metriqon. By registering, you represent and warrant that you meet this requirement.

Accurate Information

You agree to provide accurate, current, and complete information during account registration and to update this information as needed. You are responsible for the accuracy of all information you provide.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or suspected security breach of your account.

Authentication

Metriqon uses Clerk for secure authentication and account management. Your account is protected by Clerk's industry-standard security measures. You agree to use only authorized methods to access your account.

4. Subscription Plans & Billing

Available Plans

Metriqon offers the following subscription tiers:

• Basic (Free): 1 metabolic analysis with core features
• Starter Plan (SGD 6.90/month): 10 analyses per month, AI meal plans, PDF report downloads, and email support
• Pro Plan (SGD 9.90/month): 30 analyses per month, all Starter features, priority support, and access to advanced metabolic insights

Billing and Payment

Subscription fees are billed monthly via Stripe. You authorize us to charge your payment method on a recurring basis. Payment is non-refundable except where required by law.

Auto-Renewal

All subscription plans renew automatically at the end of each billing cycle. You will be charged the amount for your current plan on your renewal date unless you cancel before that date.

Cancellation Policy

You may cancel your subscription at any time from your account settings. Your access to paid features will continue through the end of your current billing cycle. No refunds are issued for unused portions of a billing period.

Price Changes

We reserve the right to change subscription prices with 30 days' notice. Your continued use of Metriqon after a price change constitutes acceptance of the new price. If you do not accept the new price, you may cancel your subscription.

5. Acceptable Use

You agree not to use Metriqon in any way that:

• Violates any applicable law, regulation, or third-party right
• Infringes on intellectual property rights of Thinkrium or others
• Transmits harmful, abusive, defamatory, or obscene content
• Attempts to gain unauthorized access to the service or its systems
• Damages, disables, or interferes with the service's operation or security
• Uses automated means (bots, scrapers, crawlers) to extract or copy data without permission
• Shares your account credentials with others or allows unauthorized access to your account
• Engages in commercial activities without explicit permission from Thinkrium
• Attempts to reverse-engineer, decompile, or discover source code or algorithms

Violations of these restrictions may result in immediate account termination and potential legal action.

6. Medical Disclaimer

Not Medical Advice

Metriqon does not provide medical advice, medical diagnosis, medical treatment, or medical recommendations. The information provided by Metriqon is for educational and informational purposes only. Any results, insights, or recommendations generated by Metriqon are not medical advice and should not be treated as such.

Metabolic Calculations Are Estimates

All metabolic calculations (BMR, TDEE, metabolic age, etc.) are estimates based on validated mathematical equations, primarily the Mifflin-St Jeor equation for BMR calculation. These calculations are approximations based on population averages and your individual input data. Actual metabolic rates vary significantly between individuals based on factors not captured in these equations, including genetics, hormonal status, medications, and lifestyle factors.

GLP-1 Medication Insights Are Educational

Metriqon provides educational information and personalized insights for users taking GLP-1 medications. These insights are not medical prescriptions or treatment recommendations. GLP-1 medication decisions, dosing, and management must be made by your healthcare provider. Never adjust, start, or stop GLP-1 medication based on Metriqon insights alone.

Meal Plans Are Suggestions Only

AI-generated meal plans provided by Metriqon are general suggestions based on your metabolic profile and stated preferences. They are not medical nutrition therapy and should not be used as a substitute for personalized nutrition counseling from a registered dietitian or nutritionist, especially if you have specific health conditions, allergies, or medical contraindications.

Always Consult Your Healthcare Provider

Before making any changes to your diet, exercise routine, supplementation, or medication based on Metriqon insights, consult with a qualified healthcare provider, registered dietitian, or other appropriate specialist. This is especially important if you:

• Have existing medical conditions (diabetes, cardiovascular disease, thyroid disorders, etc.)
• Are taking medications or supplements
• Are pregnant, breastfeeding, or planning pregnancy
• Have a history of eating disorders
• Are considering starting new medications, including GLP-1 agonists
• Experience sudden or unusual changes in health or metabolism

No Liability for Health Outcomes

Thinkrium is not liable for any health outcomes, injuries, adverse effects, or medical complications resulting from use of Metriqon, reliance on its insights, or failure to seek appropriate medical care. You use Metriqon entirely at your own risk and responsibility for your health rests with you and your healthcare providers.

Accuracy Limitations

While we strive for accuracy, Metriqon calculations and AI-generated insights have inherent limitations. Results may be inaccurate due to errors in user input, limitations in the underlying algorithms, or individual variations not captured by the calculations. You should never rely solely on Metriqon for health decisions.

7. Intellectual Property

Ownership of Content

All content, features, and functionality of Metriqon, including but not limited to text, graphics, logos, design, layout, algorithms, and source code, are the exclusive property of Thinkrium and protected by applicable copyright, trademark, and other intellectual property laws.

Our Proprietary Algorithms

The algorithms, methodologies, and AI models used in Metriqon calculations and meal plan generation are proprietary to Thinkrium. You may not attempt to reverse-engineer, replicate, or derive these algorithms without explicit written permission.

Limited License

We grant you a limited, non-exclusive, non-transferable license to use Metriqon solely for your personal, non-commercial purposes, in accordance with these terms. You may not copy, modify, distribute, transmit, or commercially exploit any Metriqon content or functionality.

Your Content

You retain ownership of personal health data you input into Metriqon. However, by providing this data, you grant Thinkrium the right to use, process, and analyze it to improve Metriqon's algorithms and services, subject to our Privacy Policy.

8. Data & Privacy

Your privacy is important to us. For complete information about how we collect, use, store, and protect your personal and health data, please review our Privacy Policy.

By using Metriqon, you consent to the data practices outlined in our Privacy Policy, including:

• Collection of personal information (name, email, demographics)
• Collection and processing of health metrics (weight, height, body composition, etc.)
• Use of data to generate personalized insights and improve our service
• Compliance with applicable privacy laws (GDPR, PDPA, etc.)
• Secure storage and encryption of your data

We never sell your personal data to third parties. Your health information is treated with the highest level of confidentiality.

9. Limitation of Liability

No Warranty

Metriqon is provided "as is" and "as available" without warranty of any kind, express or implied. We make no warranties regarding accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement of intellectual property rights.

Health Outcome Disclaimer

Thinkrium is not liable for any health outcomes, medical complications, injuries, or adverse effects resulting from your use of Metriqon, your reliance on its insights, or your failure to seek professional medical advice. You are solely responsible for your health decisions and outcomes.

Service Interruption

Thinkrium is not liable for service interruptions, downtime, data loss, or technical failures, including those caused by maintenance, updates, or circumstances beyond our control.

Limitation of Damages

In no event shall Thinkrium be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.

Your Sole Remedy

Your sole remedy for dissatisfaction with Metriqon is to discontinue use of the service. Our liability is limited to the amount you have paid for Metriqon in the 12 months preceding the claim.

10. Termination

Termination by You

You may close your account and discontinue using Metriqon at any time. You can delete your account through your account settings. Upon deletion, your personal data will be handled according to our Privacy Policy.

Termination by Thinkrium

We may suspend or terminate your account immediately, without notice, if you violate these terms, engage in unlawful activity, or misuse the service. We may also terminate your account for inactivity or other legitimate business reasons, with reasonable notice when possible.

Effect of Termination

Upon termination, your right to use Metriqon ceases immediately. You will lose access to your account, data, and all associated services. Some provisions of these terms (including medical disclaimer, limitation of liability, and governing law) survive termination.

11. Governing Law

These Terms of Service and your use of Metriqon are governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of Singapore to resolve any disputes arising from these terms or your use of Metriqon.

12. Changes to Terms

Thinkrium reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of Metriqon after such modifications constitute your acceptance of the updated terms. We encourage you to review these terms periodically to stay informed of any changes.

If we make material changes that substantially reduce your rights, we will provide at least 30 days' notice, and you may terminate your account if you do not accept the new terms.
